Terms of Service

These Terms of Service govern your use of SAFEMARK's website, products, and services. By using SAFEMARK, you agree to these terms. Please read them carefully before making a purchase or creating an account.

1. Acceptance of Terms

  • By purchasing, using, or accessing SAFEMARK products or services, you agree to be bound by these Terms of Service.
  • If you do not agree to these terms, do not use our services.
  • These terms apply to all users including vehicle owners, vendors, and visitors.
  • We reserve the right to update these terms at any time with reasonable notice.

2. Description of Service

  • SAFEMARK provides QR-based vehicle identification stickers that enable masked communication between vehicle owners and third parties.
  • Our service includes: QR sticker, masked calling system, scan logs, emergency contact feature, and vendor management.
  • The service is provided on a subscription basis, renewed annually.
  • SAFEMARK is not a telecommunications provider. Masked calls are facilitated through third-party infrastructure.

3. User Responsibilities

  • You must provide accurate and truthful information during registration and purchase.
  • You are responsible for keeping your account credentials secure.
  • You must not use SAFEMARK for any illegal, fraudulent, or abusive purpose.
  • You must not attempt to reverse-engineer, copy, or replicate our QR system or calling infrastructure.
  • You must ensure your vehicle number entered matches the actual vehicle the sticker is placed on.

4. Acceptable Use

  • SAFEMARK may only be used for legitimate vehicle safety and emergency contact purposes.
  • Using SAFEMARK to stalk, harass, or repeatedly contact vehicle owners is strictly prohibited.
  • Scanning QR codes for purposes other than genuine vehicle-related communication is not permitted.
  • Vendors may not resell, duplicate, or transfer stickers purchased at vendor price to non-genuine buyers.
  • Violation of acceptable use may result in immediate account termination without refund.

5. Payment and Subscription

  • All prices are in Indian Rupees (INR) and inclusive of applicable taxes.
  • Payments are processed securely via Razorpay. SAFEMARK does not store payment card details.
  • Subscriptions are valid for 12 months from the date of activation.
  • No automatic renewal — you will be notified 30 days before expiry to manually renew.
  • Refunds are available within 7 days of purchase if the sticker has not been delivered.

6. Vendor Terms

  • Vendors must provide accurate business information including valid Aadhar for identity verification.
  • Commission of ₹50 per sticker is credited to vendor wallet upon confirmed sale.
  • Withdrawals are processed within 3–5 business days via UPI or bank transfer.
  • SAFEMARK reserves the right to withhold payments in case of fraudulent activity.
  • Vendor accounts found to be engaging in fraud will be permanently terminated.

7. Limitation of Liability

  • SAFEMARK is a communication facilitation tool — we are not responsible for outcomes of contacts made through our platform.
  • We do not guarantee availability of the masked calling service 100% of the time due to third-party dependencies.
  • SAFEMARK is not liable for any damages arising from misuse of the QR sticker by third parties.
  • Our total liability to any user shall not exceed the amount paid by that user in the preceding 12 months.

8. Intellectual Property

  • All SAFEMARK branding, logos, QR technology, and software are the intellectual property of SAFEMARK.
  • Users are granted a limited, non-transferable license to use the service for personal or business purposes.
  • You may not reproduce, distribute, or create derivative works from SAFEMARK materials without written permission.

9. Termination

  • You may cancel your SAFEMARK account at any time from your dashboard.
  • SAFEMARK may terminate accounts that violate these terms, with or without notice.
  • Upon termination, your QR code will be deactivated and scan data will be deleted after 90 days.
  • No refund will be provided for unused subscription time in case of termination due to policy violation.

10. Governing Law

  • These terms are governed by the laws of India.
  • Any disputes shall be subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan.
